Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE IN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
BY ENTERING THE GIG CAR SHARE SPRING BREAK 2024 SWEEPSTAKES (THE “SWEEPSTAKES”), YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR FROM YOU, A LIMITATION OF YOUR RIGHTS AND REMEDIES, BINDING ARBITRATION OF CLAIMS, WAIVER OF CLASS ACTION CLAIMS, AND WAIVER OF THE RIGHT TO TRIAL BY JURY.
OVERVIEW:
The GIG Car Share Spring Break 2024 Sweepstakes is sponsored by A3 Mobility LLC, 1277 Treat Blvd., 3rd Floor Walnut Creek, CA 94597 ("Sponsor"). The Sweepstakes Period begins at 12:00:00 AM Pacific Time on March 18, 2024 , and ends at 12:00:00 AM Pacific Time on April 1, 2024.
As described in more detail below, eligible individuals may submit one Sweepstakes entry per day during the Sweepstakes Period one of two ways: a) by entering the promotional code GIGSB24 in the Gig app, and taking trips in a Gig vehicle that originate in Gig Bay Area HomeZones or Seattle HomeZones; or b) by sending an email to [email protected] during the Sweepstakes Period. Eligible individuals may submit one Sweepstakes entry per day over the Sweepstakes Period.
One (1) grand prize winner for the Gig Bay Area market (“Bay Area”) and one (1) grand prize winner for the Gig Seattle market (“Seattle”) will be selected from all eligible entries submitted throughout the Sweepstakes Period, as more fully described below. Additionally, for each weekday during the Sweepstakes Period, one (1) winner for the Bay Area and one (1) winner for Seattle will be selected from among all eligible entries submitted that day.
ELIGIBILITY:
This Sweepstakes is open to individuals who are eighteen (18) on the date of entry into this Sweepstakes and reside in areas where the Gig app is available for download. Employees, officers, directors, members, managers, agents, and representatives of AAA of Northern California, Nevada & Utah; A3 Ventures LLC; A3 Mobility LLC; AAA Arizona Car Buying Services LLC or their respective parent and subsidiary companies, affiliates, divisions, franchisees, representatives, consultants, sub-contractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies (collectively “Released Parties") and members of their immediate families (defined for these purposes as including any spouse, partner, parents, legal guardians, children, legal ward, grandparent, grandchild and siblings and each of their respective spouses) and individuals living in the same household as such persons (whether or not related), are not eligible. This Sweepstakes is void where prohibited by law.
METHOD OF ENTRY:
During the Sweepstakes Period, eligible individuals can enter the Sweepstakes by downloading the Gig app, (available on Apple’s app store or on Google Play), completing a registration process and entering
GIGSB24 at the Gig app’s Payments and Promotions option. Then they must reserve a car through the app and return the car by the time identified in the reservation, which must be before the end of the Sweepstakes Period (a “Ride”). Existing Gig Members can enter GIGSB24 at the Gig app’s Payments and Promotions option before reserving a car. The GIGSB24 code only needs to be entered once during the Sweepstakes Period prior to taking the first Ride. One Ride constitutes one Sweepstakes entry. Limit one entry per day. Rides initiated in the Bay Area HomeZone will be entered into the Bay Area drawings and Rides initiated in the Seattle HomeZone will be entered into the Seattle drawings. The App's Privacy Policy is located at https://mwg.aaa.com/privacy-policy. The Terms of Use are located at https://gigcarshare.com/member-agreement/.
Alternatively, eligible individuals may enter by sending an email to [email protected] during the Sweepstakes Period with your full name, full mailing address, email address used in connection with your Gig account or email address that you plan to use in connection with a Gig account. The subject line of your email must read "Seattle Gig Spring Break Giveaway Entry 2024" or “Bay Area Gig Spring Break Giveaway Entry 2024.” Emails with a subject line referencing the Bay Area will be deemed entries into the Bay Area drawings and emails with a subject line referencing Seattle will be deemed entries into the Seattle drawings.
Limit one entry per person, per day of the Sweepstakes Period, in either the Bay Area or Seattle, irrespective of entry method.
For purposes of this Sweepstakes, an entry is earned only upon the following: when the app’s servers record the submission of an entrant’s reservation with all required information and the GIGSB24 promotion code, and the entrant has returned the car by the time identified in the reservation, which must be before the end of the Sweepstakes Period, or if entering via email, when Sponsor or its authorized representative actually receives the email from the entrant with all required information. Email messages that do not contain all of the required information will be disqualified. Entries must be submitted during the Sweepstakes Period, through the app or via email, in strict accordance with the instructions and restrictions in these Official Rules.
Each entrant should review all personal information entered for accuracy purposes and make all corrections necessary to inaccurate data before submitting their entry. The app clock will be the official timekeeper for entry into this Sweepstakes using the app. Those who do not provide the required entry information in the app, including the GIGSB24 promotion code, return their car by the time identified in their reservation and before the end of the Sweepstakes Period, or abide by these Official Rules and other instructions of Sponsor and its representatives, including those applicable to entry by email, may, in Sponsor’s sole discretion, be disqualified and all associated entries void. Attempts made by an individual to submit entries in excess of any limit or otherwise in violation of these Official Rules by using multiple or false contact information or otherwise may be disqualified. Purported entries that are forged, altered, incomplete, lost, late, inaccurate, misdirected, mutilated, illegitimate, incomprehensible, unintelligible, garbled, or generated by a macro, bot, or other automated means will not be accepted and will be void. Proof of sending an email to enter, such as a copy of the message in a "sent" or similar folder or a confirmation or "thank you" screen or message, does not constitute proof of actual receipt by Sponsor of an entry for purposes of this Sweepstakes. Entries or participation made on your behalf by any other individual, made by any entity or group or made at any website or through any other app will be declared invalid and disqualified for this Sweepstakes. As a condition of entering the Sweepstakes, without limiting any other provision in these Official Rules, each entrant gives consent for Sponsor and its agents to obtain and deliver their name, address, and other information and content provided by the entrant to third parties for the purpose of administering this Sweepstakes and complying with applicable laws, regulations, and rules. ANY ENTRY OR ENTRANT CONTENT THAT DOES NOT CONFORM TO THE REQUIREMENTS IN THESE OFFICIAL RULES MAY, IN SPONSOR’S SOLE DISCRETION, BE DEEMED INELIGIBLE.
By participating in this Sweepstakes via your wireless mobile device, you may be charged for standard data sent and received from your mobile device according to the terms in your wireless service provider’s data plan. Normal carrier charges and other charges may apply to data use and will be billed on your wireless device bill or deducted from your pre-paid balance. Each wireless carrier’s rate plan may vary, and you should contact your wireless carrier for information on charges relating to your participation in this Sweepstakes. Check your device’s capabilities for specific instructions and your wireless service provider’s data plan. Data service and wireless service are not available in all areas, from all mobile device service carriers, and with all mobile phones, handsets, or other devices. If your device is connected to an Internet Service Provider, normal Internet access and usage charges imposed by your Internet Service Provider may apply.

Grand Prize
One (1) winner for the Bay Area and one (1) winner for Seattle, subject to verification, will receive a prize consisting solely of $200 in GIG Car Share credits.
All GIG Car Share credits are redeemable for only future GIG Car Share reservations made within 30 days of receipt of the credits, subject to terms identified in the app. The approximate retail value of all prizes is equal to the dollar amount in credits.
All prize details not specifically stated in these Official Rules will be determined by Sponsor in its sole discretion. All taxes (national/federal, state/provincial/territorial, and local), as well as any expenses not specified in these Official Rules as being provided as part of the prize(s), are the sole responsibility of winner. Sponsor is not responsible for any inability of any winner to accept or use any prize (or portion thereof) for any reason. Winner is strictly prohibited from selling, auctioning, trading or otherwise transferring any part of a prize, except with Sponsor’s permission, which may be granted or withheld for any reason in its sole discretion. No transfers, prize substitutions or cash redemptions will be made, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute any stated prize or portion thereof with another prize or portion thereof of equal or greater value for any reason, including, without limitation, prize unavailability. No more than the stated prizes will be awarded. Entrants waive the right to assert, as a cost of winning any prize, any and all costs of verification and redemption or travel to claim the prize and any liability and publicity which might arise from claiming or seeking to claim said prize.
WINNER SELECTION/ODDS/NOTIFICATION:
The winner of the prizes detailed in the "Prizes, & Approximate Retail Value" section above will be selected in a random drawing from among all eligible entries received, subject to verification. Odds of winning a prize depend on the number of eligible entries received.
The drawings for each Weekday Prize will be held on the business day following each weekday of the Sweepstakes Period. The drawing for the Grand Prize will be held on April 3, 2024. Within two (2) business days after the selection of the potential winner[s], Sponsor or its designee will attempt to notify each potential winner that he or she may have won a prize, by email or by using other contact information provided for entry, in Sponsor’s sole discretion.
Once a potential winner has been notified and their Gig account has been verified, Sponsor will apply GIG Car Share credits to their Gig account within 48 hours. If a potential winner does not already have a Gig account, they must download the app and complete the registration process within 1 week of being notified otherwise they may be deemed to have forfeited their prize.
Each potential winner may – if requested by Sponsor – be required to complete and return to Sponsor an affidavit/liability release, as well as taxpayer documentation, in the form provided by Sponsor (without revision) and in the time period set out in Sponsor’s instructions or prize may be forfeited, as determined by Sponsor in its sole discretion. Sponsor has no liability for inability of an entrant to accept a prize for any reason or failure of any prize to reach winner due to incorrect contact information, delivery failure, or any kind of email filtering. Winner gives permission for Sponsor to disclose his/her name, city/state, and prize info to third parties (incl. publication on a winners’ list).
RELEASE/DISPUTES/GENERAL: Sponsor reserves the right to terminate, modify or suspend the Promotion or any individual Sweepstakes (in whole or part) if any part of the Promotion or a Sweepstakes becomes incapable of running as planned for any reason, incl. if there is any suspected or actual tampering with the entry process or Sponsor otherwise believes that the administration, security, or fairness of the Promotion/Sweepstakes has been compromised. EACH PARTICIPANT AGREES TO RELEASE AND HOLD SPONSOR PARTIES HARMLESS FROM AND AGAINST LIABILITY FOR INJURIES OR DAMAGES SUSTAINED IN CONNECTION WITH PARTICIPATING IN ANY PROMOTION- OR PRIZE-RELATED ACTIVITY. Promotion and any dispute related thereto will be governed by California law. Each participant agrees (to the extent permitted by applicable law) to settle all disputes only through binding individual arbitration, except Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in San Francisco, California, and any other court with jurisdiction over the parties. Arbitration proceedings will be conducted before a sole arbitrator under the Streamlined Arbitration Rules & Procedures of JAMS Inc., and, if an in-person hearing is required, it will take place in or near your home county. Either party may, notwithstanding this provision, bring qualifying claims in small claims court. In no event will you seek or be entitled to rescission, injunctive or other equitable relief, provided that nothing herein will restrain a CA resident’s right (of any) to seek public injunctive relief as permitted by applicable law. Participants irrevocably waive any right to bring or participate in a class, concerted, or consolidated action or arbitration.
WINNER INFORMATION: For information on the winner(s) of any Sweepstakes, email [email protected] within 3 months of the applicable Sweepstakes Period. Use the subject “GIG Car Share Spring Break Sweepstakes – Winner List” and clearly identify the dates of the particular Sweepstakes about which you’re requesting information in the body of the email. Limit one (1) request per email.
USE OF PERSONAL INFORMATION: Personal information collected in this Promotion will be used by Sponsor in accordance with its privacy policy (https://mwg.aaa.com/privacy-policy). You may also be asked to consent to a release permitting AAA to reuse answers provided in your survey for its own advertising or other purposes.
